Build 2 Rent Terms of Service

Effective Date: August 24, 2026

These Terms of Service govern your access to and use of build2rent.com and related applications (the "Service"), operated by Build 2 Rent LLC. By creating an account, browsing listings, or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service.

2. Description of the Service

Build 2 Rent operates a marketplace and community platform connecting real estate investors with builders and other professionals in the build-to-rent (BTR) industry, including property listings, market research and calculators, a community/network directory, and consultation scheduling. Build 2 Rent is not a real estate broker, lender, financial advisor, or law firm. We do not participate in, guarantee, or take responsibility for any transaction between users. Nothing on the Service constitutes investment, legal, tax, or financial advice, including for 1031 exchanges.

3. Accounts

You may create an account using email/password or a third-party sign-in method including Google. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. User Content

You are solely responsible for any listings, messages, or other content you submit. You grant Build 2 Rent a non-exclusive, worldwide, royalty-free license to host and display your content. We may remove content that violates these Terms.

5. Prohibited Conduct

You agree not to post false or fraudulent listings, impersonate others, use the Service unlawfully, scrape data without authorization, or interfere with the Service's operation or security.

6. Third-Party Listings and Links

Listings and posts are submitted by third parties; Build 2 Rent does not verify their accuracy and is not responsible for third-party content or linked websites.

7. Fees

Certain features may require payment, disclosed to you before you incur them. Fees are non-refundable except as required by law.

8. Intellectual Property

The Service, excluding User Content, is owned by Build 2 Rent or its licensors and protected by intellectual property laws.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Build 2 Rent will not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

11. Indemnification

You agree to indemnify Build 2 Rent from claims arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account for conduct that violates these Terms. You may delete your account at any time.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida. Disputes will be resolved in the state or federal courts located in Lee County, Florida.

14. Changes to These Terms

We may update these Terms from time to time, posting the revised version with a new effective date.
